These general conditions of sale express the entirety of the obligations of the parties. They are accessible by clicking on the General Conditions of Sale link at the bottom of the wine selection and order validation pages.

In this sense, the customer declares to be of legal age and to accept without reservation all the provisions provided for herein. Similarly, no general or specific condition appearing in the documents sent or delivered by the consumer may be incorporated herein, since these documents are incompatible with these general terms and conditions.

The offers offered via our website www.caveau.provenquiere.fr are exclusively reserved for private customers. 

1: Purpose

The purpose of these general terms and conditions is to define the rights and obligations of the parties in the context of the online sale of goods and services offered by SARL Les Domaines Robert to the customer. 

2: Products

SARL Les Domaines Robert presents products that comply with the standards and characteristics provided for in article L 111-1 of the Consumer Code, which provides the possibility for the potential customer to know before taking an order the main characteristics of the products he wishes to buy, for sale via its website.

The offers presented by SARL Les Domaines Robert are valid within the limits of available stocks, the wines are offered while stocks last. In the event of a shortage for a wine reference ordered, SARL Les Domaines Robert may study all solutions to modify, exchange or refund the order with the customer's agreement. 

3: Order confirmation

The customer will be informed by e-mail of the progress of his order as well as confirmation of payment. All the information necessary for the proper execution of the order will be recalled on this occasion. 

4: Price

The prices of the items are in Euros (€), all taxes included (TTC), at the reference VAT rate on the date and time of validation of the order by the customer and shipping costs included. Payment of the total amount indicated on the order form must be made when ordering. 

5: Payment Terms

The amount corresponding to the items ordered is payable in full to SARL Les Domaines Robert upon validation of your order form on the site using one of the following payment methods:

Payment methods

Online: Secure payment by bank cards with the CB, VISA, EUROCARD, MASTERCARD acronym. When ordering on the internet, select the method of payment by credit card, then indicate your card number, the name of the cardholder, the expiry date and the cryptogram on the back of the card. The seller guarantees the security of the transaction via its banking partner: Crédit Agricole. All information is encrypted with the "Secure Socket Layer" SSL security key. 

6: Product Availability

The availability (present or future) of the products is given independently for each item on our website. 

7: Delivery mode and time

Delivery, in metropolitan France, is made to the address indicated by the customer on the order form. A billing address can be added when filling out the contact details form. The customer guarantees that the data he will provide to SARL Les Domaines Robert is accurate, complete and verifiable. He undertakes to inform SARL Les Domaines Robert immediately of any change concerning him. 

A minimum of one 75 cl bottle is required to validate your order. 

Delivery times are generally 10 to 15 days, or 3 to 4 weeks in exceptional cases. SARL Les Domaines Robert undertakes to inform the customer of any incident that prevents it from meeting this delivery time. 

8: Shipping cost

The delivery costs amount to 18 euros for any order less than 150 euros of purchase. Delivery is free of charge for purchases from 150 euros. It is not possible to place orders on the website for shipments abroad. For this type of order, contact us directly by email at contact@provenquiere.com

9: Transport and Liability

In accordance with article L 133-3 of the commercial code, any anomaly concerning the delivery (damage, missing product compared to the delivery slip, damaged package, damaged products, etc.) must be reported in handwritten form on the slip of delivery, accompanied by the customer's signature. The consumer must report this anomaly by sending the carrier within three (3) working days following the delivery date a registered letter with acknowledgment of receipt setting out and confirming the complaints set out on the delivery slip. The consumer must send a copy of this letter by simple mail to SARL Les Domaines Robert, Domaine la Provenquière 34310 CAPESTANG. No action may be taken for any reason whatsoever if the customer receiving the shipment has not complied with the requirements set out above. 

10: Product Return

Pursuant to Article L. 121-16 of the Consumer Code, it is possible to return the product to the address of SARL Les Domaines Robert, at your expense, within seven (7) days from the date of delivery, for exchange or refund, in good condition and in its original packaging with the original invoice.

Only products returned as a whole, in their complete and intact original packaging, and in perfect condition for resale will be taken into consideration. Any product that has been damaged or whose original packaging has been damaged will not be refunded or exchanged.

This right of withdrawal is exercised without penalty and without charge except for the cost of return. In the event of the exercise of the right of withdrawal, the customer has the choice to request: either the reimbursement of the sums paid, or the exchange of the product. In the case of an exchange, the reshipment will be at the customer's expense.

In case of exercising the right of withdrawal, the customer will be refunded within 15 days. The customer will then be reimbursed by bank check to his order.

12: Force Majeure

Neither party will have failed in its contractual obligations, insofar as their execution is delayed, hindered or prevented by a fortuitous event or force majeure. Any similar facts or circumstances, external to parties, unforeseeable, inevitable, beyond the control of the parties and which cannot be prevented by the latter, despite all reasonably possible efforts and those usually retained by the case law of French courts and tribunals will be considered as fortuitous event or force majeure: the blockage of means of transport or supplies, earthquakes, fires, storms, floods, lightning, the shutdown of telecommunications networks or difficulties specific to telecommunications networks external to customers. The two parties will come together to examine the impact of the event on the execution of the order and agree on the conditions under which it will be continued. 

13: Applicable law

Only French law is applicable for all our transactions, the language used is French. The court of Béziers is the sole jurisdiction. This is for the fund rules as well as the rules of form. In the event of a dispute or complaint, the consumer should first contact SARL Les Domaines Robert in order to obtain an amicable settlement. 

14: Data protection

The information requested from the customer is necessary for the processing of his order and may only be communicated to the contractual partners involved in the execution of this order. The customer may oppose such communication, or exercise his rights of access and rectification with regard to the information concerning him and appearing in the files of SARL Les Domaines Robert under the conditions provided for by the law of 6 January 1978.

15: Protection of minors 

In accordance with article Lr3342-1 et seq. of the Public Health Code which stipulate that the sale or offer of alcohol to minors under the age of 18 is prohibited, and the buyer agrees to have completed 18 years old on the date of the order. 

16: Modification, Interruption and Termination

SARL Les Domaines Robert is entitled, at its sole discretion, to add, delete or modify at any time all or part of the services included in the website, to interrupt it momentarily or to terminate this licence. The legal notices may also be modified or adapted at any time. You are invited to consult them regularly and to respect them without reservation.
